2010 California Plastic Surgery Law
California has enacted a number of new laws as we turn into 2010. One of the big keys is the new plastic surgery law that came about after the death of the mother of Kanye West. The new law is called the Donda West Law. Donda was the mother of erstwhile celebrity Kanye West. Yes, the one who interrupts acceptance speeches to voice his opinion on who really should have won the award in question. Regardless of what you think about him, the death of his mother was certainly a tragedy as it would have been with the death of any mother.

So, what exactly happened to give rise to such a law? Donda West was desirous of getting a body makeover in 2007. After various consultations, she went in to have abdominal tuck, breast surgery and liposuction. Complications occurred following the surgery and she subsequently died.
The question in her case was whether the plastic surgeon was required to give her or have another doctor give her a physical exam. Why was this a question? Donda was in such bad physical shape that an exam would have discovered she had a host of problems including coronary disease and that undergoing surgery was a huge risk.

The Donda West Law now requires "an appropriate physical examination within 30 days of a procedure and "written clearance" from a doctor, nurse practitioner or physician's assistant before cosmetic surgery is performed. The basic idea is to make sure the patient is in good enough shape to actually undergo such a procedure without risking their life more than would be the case in any surgery.
The death of Donda West was an avoidable tragedy. Perhaps it will have a silver lining in that the law carrying her name will help prevent further deaths in California.
